The following letter was receive by us from Wm. F. Tooley.  The letter included an attachment that describes a Natural alternative way to improve lake water quality without draining or drawing down a lake and at less cost.  Click here to read the report BSR Bio-Sediment Reduction.

Our group is involved in Lake Issues in other states and have learned about your situation

I hope I am not providing more info than you need.

 

All DNR’s operate under the Federal Public Trust Doctrine.

This doctrine mandates DNR responsibility for preserving both the quantity and quality of public waters!

Theoretically the DNR could be violating their federal mandate by permanently lowering your lake.

They may also be “taking” your rights as a lake owner and the public’s rights to use.

 

Any good lawyer should be able to stop their actions immediately, pending review of this Doctrine.

 

To understand the doctrine, Google “Wisconsin constitution article 9, section 1 Public trust doctrine”

This one is easy to find.  Other states are similar, but do not make them as visible.

 

I have also attached a 2 page info sheet on “Bio-Sediment Reduction” – an alternative to dredging and drawdown.

This is an option the DNR may not have shared with you.  BSR returns lakes to their pristine condition – naturally!

    "... And I will hope along with you that this experiment results in saving two more Iowa shallow lakes from recreational development. . . . Congratulations! . . . "

Verbatim Quote from Mike McGhee, Manager, Lake Restoration & Water Quality Improveent Program, at the DNR Informational meeting on July 28, 2009:

“…Current restoration program in Iowa prioritized 131 significant public lakes. I’ll tell you right up front, North Twin Lake is one of those 131 and South Twin Lake is not. And the factors for water quality public benefit, feasibility of restoration and then we have a we have a working priority list of about 35 of our top priority lakes and that we’ve been working on, we’ve added a few. This is where we are today, concentrating our effort, and we’ve provided a science based approach to lake restoration to the legislature and the legislature stepped up to the plate about 4 or 5 years ago and dramatically increased funding for lake restoration around the state. Our plan is adopted each year as proposed to the infrastructure subcommittee and they approve it and it gives our criteria guidelines and goals and our plans of upcoming years and what we’ve accomplished in the past year....”



Excerpt from the Iowa DNR December 26,  2006  "Lake Restoration Annual Report and Plan submitted to the Joint Appropriations Subcommitte on Transportation, Infrastructure, and Capitals and Legislative Services Agency".

......In 2006 a prioritized list of at least 50 shallow lakes to be "renovated" over the next 10 years was established by Ducks Unlimited and the Iowa DNR's Wildlife and Fisheries bureaus. The first lake to be renovated is Diamond Lake in Dickinson County. Renovation began during Summer 2006. Renovations in 2007 and 2008 are planned for the next six lakes on the list. Those lakes tentatively scheduled for 2007 include: Dan Green Slough, in Clay Co., and Pickerel Lake in Buena Vista Co. Planned renovations for 2008 include South Twin Lake in Calhoun Co., Virgin Lake in Palo Alto Co., and Lizard Lake In Pocahontas County.....
